After a delayed opening of the 2019 EEO-1 data collection site in light of the pandemic, the 2019 and 2020 EEOC data collection system is now open and fully operating.  Employers have until July 19th, 2021, to submit two years’ worth of reports.  The EEO-1 report is a compliance survey that requires company employment data to be categorized by race/ethnicity, gender, and job category.  All private employers with 100 or more employees and government contractors with 50 employees and 50,000 in contracts are required to submit the EEO-1 Report annually.  

    Failure to file an EEO-1 report for federal contractors can lead to the Office of Federal Contract Compliance Programs (OFCCP) canceling, terminating, or suspending all or a portion of any federal contract held by a non-compliant employer. Non-compliant federal contractors may also be subjected to permanent debarment or debarment for a specified period of time. The penalties against employers who file willfully false EEO-1 reports are much more significant and are punishable by fines or imprisonment.
